Feds Ask 4th Circ. To Uphold Ex-Massey Official's Conviction

Law360, New York (June 29, 2012, 7:42 PM EDT) -- Prosecutors on Thursday urged the Fourth Circuit to uphold the conviction of Massey Energy Co.'s former security chief for obstructing a federal probe into an April 2010 mining disaster, arguing the district judge properly denied his efforts to suppress statements made in a deposition.

In a brief filed with the federal appeals court, U.S. Attorney R. Booth Goodwin II challenged Hughie Elbert Stover’s contention that he was improperly in custody at the time he made the allegedly incriminating statements, thus rendering the statements invalid evidence....
