7th Circ. Revives Suit Over PetSmart's 'Prescription' Cat Food

Law360 (August 21, 2019, 5:02 PM EDT) -- A Seventh Circuit panel revived a class action brought by cat owners who say PetSmart and the pet food maker Hill's misled consumers with deceptive "prescription" cat food labels, ruling Tuesday that the cat owners pled their case with enough specificity to keep their fraud claim alive.

The judges, ruling that cat owners Holly Vanzant and Dana Land sufficiently pled their fraud claims, addressed the larger consumer issue plaguing the pet food industry that they raised.
