3rd Circ. Pans US Airways Passenger's Mistaken-Meal Suit
By Andrew Scurria (December 13, 2013, 6:55 PM EST) -- The Third Circuit refused Friday to flip a verdict that cleared US Airways Group LLC of triggering a passenger's midair allergic reaction with the wrong preordered meal, finding that a Pennsylvania jury had acted reasonably.
A unanimous panel soundly rejected Judith Schaefer-Condulmari's argument that the jury disregarded the weight of evidence when it turned down claims that she had requested a gluten-free meal when booking a Rome-to-Philadelphia flight but was served a vegetarian option instead.
