3rd Circ. Adopts Test To Evaluate Meal Breaks Under FLSA

Law360, New York (November 24, 2015, 8:11 PM EST) -- The Third Circuit in a split ruling Tuesday upheld a lower court’s decision to dismiss a lawsuit filed by Pennsylvania prison guards, adopting for the first time a test to determine whether a meal period is compensable under the Fair Labor Standards Act.
