DC Circ. Tosses LPTV Challenge To Spectrum Auction

Law360, New York (August 30, 2016, 8:08 PM EDT) -- The D.C. Circuit nixed a challenge brought by low-power television broadcasters against a Federal Communications Commission decision to repurpose their spectrum in the ongoing incentive auction, finding Tuesday that the LPTVs had been subject to displacement by wireless licensees “long before” the auction.
