Plaintiffs Get Burned In McDonald's French Fry MDL

Law360, New York (May 7, 2009, 12:00 AM EDT) -- A federal judge has rejected class certification for the plaintiffs in multidistrict litigation attacking McDonald's Corp. over trace amounts of wheat gluten and casein in the fast food giant's french fries, the presence of which the company denied until 2006.

Judge Elaine E. Bucklo of the U.S. District Court for the Northern District of Illinois ruled Wednesday that the proposed nationwide class was overinclusive because it was not limited to individuals who purchased french fries or hash browns from McDonald's based on the company's false representations...
