Hurricane Suit Against Insurer Not Untimely: Judge

Law360, New York (May 7, 2009, 12:00 AM EDT) -- A federal judge has dismissed Lexington Insurance Co.'s motion to toss a lawsuit brought by a Florida golf course that suffered damage from Hurricane Wilma, finding that the insurer's claim that the suit was untimely did not hold up under state law.

Judge William S. Zloch on Wednesday denied Lexington's motion for summary judgment, ruling in favor of Scratch Golf LLC in the U.S. District Court for the Southern District of Florida.
