Black FDNY Applicants Get Class Cert. In Bias Suit

Law360, New York (May 12, 2009, 12:00 AM EDT) -- A federal judge has certified a class of black firefighters in a suit brought by the U.S. Department of Justice claiming New York City's fire department discriminates against black and Hispanic applicants through its written examinations.

Judge Nicholas G. Garaufis granted class certification on Monday in the U.S. District Court for the Eastern District of New York to a group of black applicants who sat for one of two written exams and were allegedly harmed by certain FDNY employment practices.
