Nissan Launches Broadside Against Faulty-Transmission Suit

Law360 (February 14, 2018, 5:23 PM EST) -- Nissan North America Inc. has asked an Alabama federal judge to throw out or trim down a proposed class action over transmission problems in thousands of its vehicles, saying the suit centers on an alleged design defect not covered by warranties and has other issues.

The carmaker was sued last year by a car rental firm and driver that said cars with Nissan's "new" continuously variable transmissions had trouble shifting, making them unsafe. But Nissan said Monday that two of four plaintiffs shouldn't be suing in Alabama, the proposed classes are too broad, and the suit doesn't allege any actual violations...
