10th Circ. Denies Injunction In Tyson Waste Case

Law360, New York (May 14, 2009, 12:00 AM EDT) -- Oklahoma's attorney general has lost a bid to stop poultry farmers from dumping waste in the Illinois River watershed while the state's environmental case against Tyson Foods Inc. is pending in federal court.

The U.S. Court of Appeals for the Tenth Circuit on Wednesday handed down an opinion affirming the denial of a preliminary injunction against Tyson Foods, finding that the state failed to meet the heightened standard required to obtain a mandatory preliminary injunction.
