Dismissal Of ERISA Action V. Owens Corning Stands

Law360 (May 14, 2009, 12:00 AM EDT) -- A federal judge has refused to set aside his earlier dismissal of a putative class action against Owens Corning’s retirement savings plan, ruling that his reasoning continues to stand up against the plaintiffs' challenges.

Judge Jack Zouhary of the Northern District of Ohio on Wednesday denied the plaintiffs' bid to amend the judgment, ruling that he had been right to dismiss defendant Fidelity Management Trust Co. from the case and ban certain allegations from the complaints based on the statute of limitations.
