Teva, Sun Still Free To Make Generic Protonix

Law360 (May 14, 2009, 12:00 AM EDT) -- Altana Pharma AG and Wyeth have failed again in their efforts to enjoin Teva Pharmaceuticals USA and Sun Pharmaceutical Industries Ltd. from producing generic versions of the anti-ulcer drug Protonix.

The U.S. Court of Appeals for the Federal Circuit on Thursday affirmed the U.S. District Court for the District of New Jersey's 2007 denial of a preliminary injunction against the generic-drug makers.
