Tokyo Chemical Co. Sues Bayer, BNSF Over Toxic Spill

Law360, New York (May 15, 2009, 12:00 AM EDT) -- A Tokyo-based chemical company has filed suit against Bayer CropScience LP, Burlington Northern Santa Fe Corp. and other defendants in an indemnification fight over a $1.8 million cleanup associated with a 2007 chemical leak in Kansas.

Ihara Chemical Industry Co. Ltd.'s suit, filed Thursday in the U.S. District Court for the District of Kansas, seeks testing to determine the exact cause of a crack in a shipping container that triggered the spill.
