Conditional Cert. Rejected In FLSA Action V. Ocwen

Law360 (May 21, 2009, 12:00 AM EDT) -- Finding that the plaintiffs in a proposed overtime class action against mortgage lender Ocwen Loan Servicing LLC have failed to sufficiently show that other similarly situated employees exist, a judge has denied their motion for conditional certification.

Judge William D. Zloch of the U.S. District Court for the Southern District of Florida on Tuesday denied the plaintiffs' request to conditionally certify the suit as a collective action and notify potential class members, as well as a joint motion to extend case deadlines.
