Suspended NJ Atty's Suit Properly Tossed, 3rd Circ. Says

Law360 (April 2, 2018, 5:06 PM EDT) -- The Third Circuit ruled Friday that a trial court was correct in tossing out a suspended New Jersey lawyer’s suit against the state’s attorney ethics office over alleged harassment, saying active disciplinary proceedings against the lawyer prevented federal courts from intervening.

The appeals court said that the Younger abstention doctrine barred the federal district court from hearing plaintiff Peter Cresci’s complaint as long as the New Jersey Office of Attorney Ethics is investigating him. Cresci, who in 2015 pled guilty to falsifying records after being indicted...
