Truck Stop Chain Nets $10M In Atty Fees After Contract Row

Law360 (April 3, 2018, 9:16 PM EDT) -- A Delaware chancellor awarded truck stop chain TA Operating LLC $9.8 million in legal fees on Monday following its win in a contract row with a fuel card payment processor.

TA won the suit in September when Chancellor Andre Bouchard of Delaware Chancery Court said it didn't break the agreement with processor Comdata by not installing radio frequency identification, or RFID, technology at its 225 locations in a timely manner, per a 2011 amendment to their existing merchant agreement. Bouchard also found that Comdata did breach the deal by initiating a termination and subsequently charging TA higher fees.
