Fashion Co. Fossil Must Face Suit Over Outlet Store Pricing

Law360 (April 10, 2018, 8:19 PM EDT) -- Fossil Group Inc. can’t get an early escape from a proposed class action alleging the company deceives consumers with phony discounts advertised at its outlet stores, a California federal judge ruled Monday, finding that the consumer leading the suit had sufficiently supported his claims about allegedly misleading price tags and signs.

U.S. District Judge Michael M. Anello found that lead plaintiff Timur Safransky had alleged in sufficient detail how he was purportedly misled by a Fossil outlet store’s in-store signage and price tags that showed he was getting multiple discounts on a bag that wasn’t ever offered at the higher-marked price....
