NuVasive Urges 9th Circ. To Toss $27M Poaching Verdict

Law360 (April 12, 2018, 11:00 PM EDT) -- Medical device maker NuVasive sought to convince the Ninth Circuit at a hearing Thursday to overturn a $27.5 million verdict awarded to a spinal device distributor that alleged NuVasive cut off its supply and then poached its employees, arguing it was within its rights to end its agreement with the distributor.

During oral arguments in Pasadena, Calif., Deanne Maynard of Morrison & Foerster LLP urged a three judge panel to toss a jury’s award of $7.5 million in compensatory damages and $20 million in punitive damages...
