Berkheimer Ruling Stops Hulu From Killing Data Patent Row

Law360 (April 13, 2018, 6:56 PM EDT) -- Hulu LLC can't slip out of an infringement suit over a handful of data organization patents, a California federal judge has found, citing the Federal Circuit's recent Berkheimer ruling to explain that it was too early to tell whether the asserted claims were patent-eligible.

U.S. District Judge John A. Kronstadt on Wednesday denied Hulu's motion to dismiss Sound View Innovations LLC's claims that the company is infringing five of its patents relating to data storage, organization and analysis, finding that there were still questions of fact about whether the asserted patent claims were invalid under the U.S. Supreme Court's Alice standard....
