Sterling Contract Doesn't Bar Class Action: Arbitrator

Law360, New York (June 2, 2009, 12:00 AM EDT) -- An arbitrator has determined a dispute resolution agreement for workers at the nation’s largest jewelry retailer, Sterling Jewelers Inc., does not bar a case alleging discrimination against female employees from proceeding as a class action.

On Monday, arbitrator Kathleen A. Roberts issued a ruling in the American Arbitration Association Employment and Class Action Arbitration Tribunal finding that the agreement concerning Sterling’s dispute resolution program, called “RESOLVE,” does not specifically bar class actions, allowing the sex discrimination claimants to seek class status.
