City Aims To End Tower Project In Deal To Add Builder's Land

Law360 (June 26, 2018, 10:03 PM EDT) -- The city of Bonita Springs, Florida, faced a skeptical bench Tuesday as it urged a state appeals court to reinstate its bid to void an agreement requiring it to approve construction of four residential towers in exchange for a developer voluntarily adding its land to the city's boundaries.

The dispute arose from a deal in which a predecessor of defendants WCI Communities LLC and WCI Communities Inc. agreed to bring 55 acres of what was unincorporated Lee County land into the city with the city's promise that it would amend its land use plan and approve the company's development application.
