Ga. Court Revives Southstar Overcharge Action

Law360, New York (June 4, 2009, 12:00 AM EDT) -- A Georgia state appeals court has decided to reinstate a proposed class action filed against natural gas marketer Southstar Energy Services LLC alleging that the company overcharged its customers under the Natural Gas Competition and Deregulation Act.

In a split decision, the Court of Appeals of the State of Georgia on Tuesday reversed a decision by a lower court, which dismissed the case on the premise that the plaintiffs’ claims were barred by the voluntary payment doctrine.
