Judge Rules Databases Not Protected By DMCA

Law360 (March 2, 2004, 12:00 AM EST) -- A federal judge in New York has ruled that the Digital Millennium Copyright Act does not apply to unauthorized database replication.

Advertising tracking company Inquiry Management Systems had sued rival Berkshire Information Systems after Berkshire allegedly downloaded almost 85% of the database on IMS’ web site.
