9th Circ. Backs Dismissal Of Ford Used Car Action

Law360, New York (June 10, 2009, 12:00 AM EDT) -- A federal appeals court has upheld the dismissal of a proposed class action accusing Ford Motor Co. and its dealerships of misleading consumers to increase sales of certified pre-owned vehicles.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit said Monday that a lower court was right to dismiss the suit brought by plaintiff William Ray Kearns for failure to plead the third amended complaint with particularity.
