Drug Cos. Assail Hospital Bellwether In Opioid MDL

Law360 (July 6, 2018, 1:33 PM EDT) -- Drug companies are directing heavy fire at a bellwether lawsuit for hospitals in multidistrict litigation over the opioid crisis, calling it a "dangerous" case that suggests health care providers can sue any business that harms an uninsured patient.

The criticism came in motions to dismiss filed on June 29 by drug manufacturers, distributors and pharmacies. The companies are targeting allegations from Florida-based West Boca Medical Center, which filed a test case for hospitals that delivered opioid-related medical treatment to indigent patients and want opioid sellers to foot the unpaid bills.
