Raymours Wins Bid To Send NJ Text Message Action To NY

Law360 (July 2, 2018, 6:14 PM EDT) -- A New Jersey federal judge has approved Raymours Furniture Co. Inc.'s bid to move a putative class action over allegedly unsolicited text messages to New York federal court based on the forum selection clause in a sweepstakes agreement to which a consumer consented when she provided her phone number to the retailer.

U.S. District Judge Brian R. Martinotti on Friday granted the company's motion to transfer Evelyn Manopla's lawsuit to the Northern District of New York, finding that she had "reasonable notice" of the terms of the online agreement and is thus bound by them.
