End Outdated Investment Treaties, EU Tells Member States

Law360, London (July 19, 2018, 3:57 PM BST) -- The European Commission told member states on Thursday to terminate redundant and outdated bilateral investment treaties with other countries in the bloc to “protect the public interest” and comply with EU law.

Europe’s highest court ruled in March that so-called intra-EU bilateral investment treaties — which establish terms and conditions for investment — had been superseded by new law.  The commission called on member states in a communication on Thursday to terminate outstanding agreements or be in breach of the law.
