United, Next Health Denied Dismissals In $100M Fraud Suit

Law360 (July 20, 2018, 5:18 PM EDT) -- A Texas federal judge did not let either United Healthcare or Next Health escape a suit claiming Next Health ran a $100 million kickback scheme, denying in part Next Health’s motion to dismiss United’s complaint while denying United’s motion to dismiss Next Health’s counterclaims.

District Judge Karen Gren Scholer rejected most of Next Health LLC’s arguments that United Healthcare Services Inc.’s claims were preempted or barred under federal and state laws while allowing that United’s claim of alter ego cannot be a separate cause of action and that United’s Texas Theft Liability Act claims were barred by the statute of limitations....
