NJ Justices Say Unreliable Evidence Kills Accutane MDL

Law360 (August 1, 2018, 6:55 PM EDT) -- The New Jersey Supreme Court on Wednesday toppled more than 2,000 cases alleging Hoffman-La Roche Ltd.'s acne drug Accutane causes gastrointestinal problems, ruling that courts must assess the scientific reliability of evidence before it's placed before a jury.

In a 90-page decision dissecting standards for the admissibility of expert testimony, the unanimous state high court said the trial court that initially tossed the multidistrict litigation had properly carried out its "gatekeeper" role in excluding the input of the patients' experts who weighed in on the association between Accutane and Crohn's disease.
