Class Cert. Denied In FLSA Suit Against Va. Schools

Law360, New York (June 22, 2009, 12:00 AM EDT) -- A federal judge has refused to conditionally certify a would-be class action accusing a Virginia school board of failing to pay overtime wages to athletic coaches, ticket takers and others who performed extra duties.

Judge James C. Cacheris of the U.S. District Court for the Eastern District of Virginia on Monday said the situations of proposed class members who worked for Fairfax County Public Schools were different enough that they could not be evaluated together.
