Ill. Village's Pollution Suit Against Exxon, CBS Tossed

Law360, New York (June 26, 2009, 12:00 AM EDT) -- Exxon Mobil Corp. and CBS Operations Inc. have won dismissal of a lawsuit brought by an Illinois town that sought to fine the companies for pollution flowing to the town from a former zinc smelting operation.

Judge Joe Billy McDade of the U.S. District Court for the Central District of Illinois on Thursday dismissed the village of DePue's lawsuit, but he gave the plaintiff room to refile claims for common law nuisance and trespass.
