Hampton Inn Not Covered For $1M Water Damage, Judge Says

Law360 (September 24, 2018, 7:43 PM EDT) -- A Hampton Inn owner is on the hook for nearly $1 million in repair costs after an Illinois federal judge ruled Monday that extensive water damage on the property isn’t covered by its insurance policy.

U.S. District Judge Sue E. Myerscough granted summary judgment to West Bend Mutual Insurance Co. after more than two years of litigation brought by the owner of a Hampton Inn in Quincy, Illinois. The hotelier had argued the Wisconsin-based insurer didn’t specify that the policy excluded “continuous or repeated seepage” and “leakage of water” claims in a pair of letters denying coverage for damage.
