Self-Insured Cos. Can Tap State Pool: Nev. Court

Law360, New York (June 26, 2009, 12:00 AM EDT) -- The Nevada Supreme Court has ruled that self-insured companies that purchased excess insurance can receive insurance payments for workers' compensation claims from a statewide insurance pool if their excess insurer is insolvent, reversing a decision by a lower court.

Justice James W. Hardesty, writing for the court en banc, ruled Thursday that casino operator MGM Mirage and Steel Engineers Inc., which were both self-insured but purchased excess coverage from now-defunct Reliance National Insurance Co., are entitled to funds from the Nevada Insurance Guarantee Association.
