Microsoft Exits Dispute Over Online Ad Patent

Law360, New York (July 1, 2009, 12:00 AM EDT) -- Another heavyweight has exited Performance Pricing Inc.’s infringement action, as the court dismissed with prejudice all allegations against Microsoft Corp., leaving Google Inc. and AOL LLC to face claims related to a patent for online marketing and transactions.

On Wednesday, Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas approved Performance Pricing’s motion to dismiss allegations against Microsoft and likewise dismissed the software giant’s counterclaims, albeit without prejudice.
