Cannabis Grower RICO Trial Puts Industry On High Alert

Law360 (October 26, 2018, 2:53 PM EDT) -- The clash between state laws legalizing cannabis and federal laws outlawing it will take center stage Monday when a Colorado federal jury considers whether landowners were damaged by a nearby grow facility as their Racketeer Influenced and Corrupt Organizations Act suit goes to trial.

In the first RICO suit involving legalized cannabis to make it to trial, a jury will consider beginning Oct. 29 whether property owned by Phillis Windy Hope Reilly and Michael P. Reilly lost value — and by how much — after a cannabis cultivation and grow facility opened near their 105 acres in Rye, Colorado.
