Off-Road Tire TM Dispute Detoured Into Arbitration

Law360 (October 26, 2018, 6:48 PM EDT) -- Camso USA can resolve trademark ownership questions in a dispute with rival industrial tiremakers in arbitration after a Georgia federal judge granted its request Thursday, saying he was "not free to deny" it.

U.S. District Judge Harold L. Murphy granted Camso's motion to pause proceedings in the suit brought by OTR Wheel Engineering Inc., FBT Enterprises Inc. and Blacksmith OTR LLC seeking to stop the North Carolina-based auto parts maker from making and selling Outrigger- and Stabilizer-branded off-road tires, saying an arbitration agreement allows Camso resolve trademark ownership questions outside court.
