BofA Fires Back In Personal Bankers OT Action

Law360, New York (July 6, 2009, 12:00 AM EDT) -- Bank of America NA has swung back at the lead plaintiff in a proposed overtime wage collective action filed on behalf of personal bankers, asserting a counterclaim seeking the repayment of three paychecks that the bank contends it sent in error.

Bank of America responded to the suit Thursday in the U.S. District Court for the Middle District of Florida, denying allegations of Fair Labor Standards Act violations against a proposed class of personal bankers and Family and Medical Leave Act violations against the named plaintiffs,...
