CAA Doesn't Regulate CO2 Emissions, Ga. Court Says

Law360, New York (July 8, 2009, 12:00 AM EDT) -- Ruling that carbon dioxide emissions are not regulated or limited by the Clean Air Act or Georgia's Air Quality Act, a Georgia appeals court has overturned a lower court's denial of an air quality permit for the construction of a pulverized coal-fired electric power plant.

The Court of Appeals of Georgia on Tuesday remanded a Fulton County Superior Court judgment invalidating an air quality permit issued to Longleaf Energy Associates LLC for the construction of a plant in Early County.
