VW Defeats Drivers' Bid To Revive Suspension Defect Claims

Law360 (December 3, 2018, 2:50 PM EST) -- Volkswagen Group of America Inc. won its bid to deny a reconsideration request from drivers attempting to revive breach of express warranty claims in a proposed class action alleging it sold CC model sedans with suspension defects in Florida federal court.

In a brief Friday order, U.S. District Judge Robert N. Scola Jr. sided with the automaker's argument that there is no basis for review and rejected the consumers' motion for reconsideration of a Sept. 26 dismissal of 10 counts outright and the elimination of individual plaintiffs from five other counts, saying that the plaintiffs made their request to reevaluate the decision...
