Tyson Can’t Shake Tenn. Donning, Doffing Suit

Law360, New York (July 13, 2009, 12:00 AM EDT) -- Tyson Foods Inc. has lost a bid to dismiss a recently filed Fair Labor Standards Act lawsuit brought by factory workers in Tennessee seeking overtime compensation for time spent donning and doffing special safety accessories.

Judge William Haynes of the U.S. District Court for the Middle District of Tennessee denied the poultry giant’s motion to dismiss on Friday, in a victory for workers of the company’s Goodlettseville facility.
