11th Circ. Won't Send Divorced Man's Kids To Switzerland
Law360 (January 16, 2019, 4:51 PM EST) -- The Eleventh Circuit on Tuesday affirmed a Georgia federal court's determination that a German man may not have his children returned to Switzerland, as his divorce agreement authorized their mother to take them to the United States.
The appellate panel affirmed the Northern District of Georgia's holding that because a judgment by a Swiss court authorized the mother to move the children to either France or the U.S. after the minors finished school in June 2017, Marcellinus Pfeiffer failed to establish that the children should be returned under the Hague Convention, according to Tuesday's opinion.
