Federal Circuit Stays Injunction In Echostar Case

Law360, New York (October 4, 2006, 12:00 AM EDT) -- Saying Echostar Communications has a substantial case on the merits, the U.S. Court of Appeals for the Federal Circuit blocked a permanent injunction Tuesday that would have forced the company to stop selling and turn off about four million of its digital video recorders.

The court said that it had reviewed Echostar’s motion papers and found that the company would likely prevail, which is the standard for winning a stay. The order will be in place while the appeal is pending.
