IBM Call Center Reps Win Conditional Cert. In OT Suit

Law360, New York (July 23, 2009, 8:26 PM EDT) -- A federal judge has granted conditional class action status in a suit alleging IBM Corp. failed to pay its workers overtime for preshift duties at the technology giant's Atlanta call center.

Judge Kenneth Karas issued the ruling Wednesday in the U.S. District Court for the Southern District of New York.

Plaintiffs' attorney Erik H. Langeland wasn't sure exactly how many IBM employees could now potentially join the lawsuit, but said he expected the number to be in the high hundreds.
