Navistar Can't Escape Wrongful Death Suit Over Truck Flip

Law360 (March 5, 2019, 5:00 PM EST) -- A New Mexico federal judge on Monday refused to put the brakes on a wrongful death and product liability case against Navistar International filed by the estate of a man who died in 2015 when a truck he was driving flipped over, rejecting arguments the court has no personal jurisdiction.

U.S. District Court Judge Kenneth J. Gonzales said that while the company may not be centrally based in New Mexico, there is still sufficient local context to support the case being heard there.
