State Claims Nixed In American Family OT Action

Law360, New York (July 29, 2009, 2:24 PM EDT) -- A federal judge has dismissed state law claims in a consolidated proposed class action alleging American Family Mutual Insurance Co. unlawfully withheld overtime pay from its auto property damage claims adjusters.

In an order Tuesday, Judge Wiley Y. Daniel of the U.S. District Court for the District of Colorado dismissed the plaintiffs' Rule 23 state law claims in proposed class actions brought by Robert Schultz and Rocky Baldozier.
