Kaleida Health Wants ERISA Suit Over Mutual Funds Tossed
Law360 (March 12, 2019, 4:25 PM EDT) -- Western New York health care provider Kaleida Health asked a federal judge to toss a suit claiming it violated the Employee Retirement Income Security Act by choosing costly mutual fund investment options for its retirement plans, saying the suit is a "generic, boilerplate complaint."
Kaleida Health said in its Monday motion to dismiss that the plan participants bringing the suit failed to show that some of the defendants acted as fiduciaries for the challenged conduct or failed to point to specific actions that suggested a fiduciary breach.
