Court Denies Texas Instruments Motion In Qualcomm Patent Suit

Law360, New York (March 17, 2004, 12:00 AM EST) -- A Delaware judge has denied a motion by Texas Instruments to dismiss a Qualcomm suit over a patent licensing agreement between the two rivals, which are seeking to gain dominance in the fiercely competitive cell-phone chip market.

Qualcomm sued Texas Instruments in July 2003 in the Delaware Superior Court for breach of the company’s patent portfolio agreement. Texas Instruments countersued in the Chancery Court.

Qualcomm then voluntarily dismissed its Superior Court case and refiled its claims in the Chancery Court action to avoid having duplicative lawsuits...
