Suit Over VW Windows Sent To State Court

Law360, New York (July 30, 2009, 1:15 PM EDT) -- A federal judge has for the second time remanded a Missouri class action accusing Volkswagen of America Inc. of selling cars with defective window regulators, ruling that an amended complaint re-alleging claims for a nationwide class that a state court has already rejected does not make the suit eligible for removal.

Judge Ortrie D. Smith of the U.S. District Court for the Western District of Missouri on Tuesday remanded the case brought under a state law on merchandising practices.
