Insurer Must Reimburse Contractor In Florida Condos Suit

By Darcy Reddan (March 26, 2019, 4:37 PM EDT) -- A Florida federal court on Monday ruled in favor of Verdex Construction in its suit seeking insurer reimbursement for payments it made to subcontractors on a condominium project, but refrained from awarding damages until Verdex and Great American Insurance Co. complete discovery.

U.S. District Judge Darrin P. Gayles adopted a magistrate judge's findings, entering summary judgment in favor of Verdex Construction LLC, which claimed that Great American is liable to reimburse it under the terms of a payment bond. The court, however, ruled the amount of damages should be determined following discovery due to discrepancies regarding whether some subcontractors were paid....
