Summary Judgment Issued Over Ulcer Medication

Law360 (October 9, 2006, 12:00 AM EDT) -- A federal court has ruled on Japanese pharmaceutical company Eisai Co. Ltd.’s motions for summary judgment in two patent infringement lawsuits involving its ulcer medicine Aciphex.

The ruling, announced by the Tokyo-based company on Monday, relates to three patent infringement cases Eisai brought against three generic drug makers—Mylan Laboratories, India’s Dr. Reddy’s and Israel-based Teva Pharmaceuticals—over their bids to market generic versions of Aciphex.
